iPredikt

iPredikt is a brand name under the company iPredikt Analytica. It is a portal/website through which a user can make predictions on various topics including but not limited to sports, politics, finance, business, climate etc. Upon accessing/using our website, the user agrees that he/she has read, understood and agreed to our terms and conditions. We reserve the right to change/modify the T&C at any time without further notice. The updated T&C will be posted on this page.

User Eligibility

Users who are eighteen (18) years of age or older are eligible to use the website. Any user that uses the service represents that he/she is older than 18 years of age and agrees to the T&C. Users should check the rules and regulations of their country of residence before registering on the website.

• The user agrees to not infringe upon the intellectual property of iPredikt including but not limited to content, logo, pictures, copyright, trademark, private information etc. iPredikt reserves the right to terminate the user registration of such person found to be violating User Conduct without any notice.
• The user agrees not to use robots, code, viruses to disable/harm the service in any way. iPredikt reserves the right to terminate the user registration of such person found to be violating User Conduct without any notice.
• The user agrees not to use the name/content of iPredikt in any capacity for personal gain. iPredikt reserves the right to terminate the user registration of such person found to be violating User Conduct without any notice.
• The user agrees to keep its password private and not share with others. If personal information of a user is disclosed due to this iPredikt will not be held responsible for any breach of private information. iPredikt reserves the right to terminate the user registration of such person found to be violating User Conduct without any notice.
• The user agrees to not gain access to another user’s account without consent/permission. iPredikt reserves the right to terminate the user registration of such person found to be violating User Conduct without any notice.

User Registration

The user agrees to the following:

• Provide accurate, current and complete information about the user. A valid email address is a must.
• The username chosen should not be deemed obscene, indecent, abusive in any way, otherwise iPredikt retains the right to terminate such an account without notice.
• Maintain the security of your password and identification.
• Take full responsibility for all use of your account and for any actions that take place using your account.
• The user should check their local laws before registering at the website. iPredikt will not be responsible for any legal issues regarding user registration.

Intellectual Property

iPredikt reserves the rights to all the content on its website including but not limited to content created by iPredikt, its partners, affiliates, licensors, associates and/or Users. The content included but not limited to Contests, software, advertisements, written content, photographs, graphics, images, illustrations, marks, logos, audio or video clippings and Flash animation etc. iPredikt owns the right of using the content posted by the user.

iPredikt does not control the content, security or any other aspect of its affiliate partners that may be listed on our website. We cannot be held responsible for any content on third party internet websites.

iPredikt, its third party partners, affiliates and advertisers are not responsible for any loss or damage of any kind incurred as a result of the decisions taken by the user based on the content posted on its website. We shall have no liability for investment, legal, medical, planning or any other decisions based upon any Content, including any predictions. Taxes Payable
All prizes shall be subject to deduction of tax ("TDS") as per the Income Tax Act 1961. As of April 1, 2018, the TDS rate prescribed by the Government of India with respect to any prize money amount that is in excess of Rs. 10,000/- is 30% of the total prize money amount. In case of any revisions by the Government of India, the TDS amount will be deducted accordingly. Winners will be provided TDS certificates in respect of such tax deductions. The Winners shall be responsible for payment of any other applicable tax, including but not limited to, income tax, gift tax, etc. in respect of the prize money.

Publicity
Acceptance of a prize by the Winner constitutes permission for iPredikt, and its affiliates to use the Winner's name, likeness, voice and comments for advertising and promotional purposes in any media worldwide for purposes of advertising and trade without any further permissions or consents and / or additional compensation whatsoever.
The Winners further undertake that they will be available for promotional purposes as planned and desired by iPredikt without any charge. The exact dates remain the sole discretion of iPredikt. Promotional activities may include but not be limited to press events, internal meetings and ceremonies/functions.

General Conditions
The decision of iPredikt in terms of awarding the prizes will be final and non-contestable. If the participant is found to be under 18 years of age then the prize money will be cancelled and account terminated.

iPredikt reserves the right to alter/modify/change the value of the prizes being offered at any time. Participants cannot raise any claim against iPredikt on its right to modify such prizes being offered..

iPredikt will not bear any responsibility for the transportation or packaging of prizes to the respective winners. We will not be held liable for any loss or damage caused to any prizes at the time of such transportation. The Winners shall bear the shipping, courier or any other delivery cost in respect of the prizes. The Winners shall bear all transaction charges levied for delivery of cash prizes. All prizes are non-transferable and non-refundable. Prizes cannot be exchanged / redeemed for cash or kind. No cash claims can be made in lieu of prizes in kind.

iPredikt shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including but not limited to any failure to perform due to unforeseen circumstances or cause beyond iPredikt's control such as acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor or materials or any cancellation of any listed event.

iPredikt may, at its sole and absolute discretion, permanently close or temporarily suspend any iPredikt Services. iPredikt can conduct promotions on the platform at any given time. . Any two or more promotions cannot be clubbed together either with any other promotional offer or cash bonus offer.

iPredikt can withdraw or cancel any contest if any governmental, statutory or regulatory compliances prohibits such a contest. Users agree not to make any claim in respect of such cancellation or withdrawal of the Contest or Contest it in any manner.

To the extent permitted under law, neither iPredikt nor its parent/holding company, subsidiaries, affiliates, directors, officers, professional advisors, employees shall be responsible for the deletion, the failure to store, the mis-delivery, or the untimely delivery of any information or material.

Dispute and Dispute Resolution

• The courts of competent jurisdiction at Noida shall have exclusive jurisdiction to determine any and all disputes arising out of, or in connection with, the iPredikt Services provided by iPredikt Analytica (including the Contest(s)), the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of the User(s) (including Participants) or iPredikt, as well as the exclusive jurisdiction to grant interim or preliminary relief in case of any dispute referred to arbitration as given below. All such issues and questions shall be governed and construed in accordance with the laws of the Republic of India.
• In the event of any legal dispute (which may be a legal issue or question) which may arise, the party raising the dispute shall provide a written notification ("Notification") to the other party. On receipt of Notification, the parties shall first try to resolve the dispute through discussions. In the event that the parties are unable to resolve the dispute within fifteen (15) days of receipt of Notification, the dispute shall be settled by arbitration.
• The place of arbitration shall be Noida, India. All arbitration proceedings shall be conducted in English and in accordance with the provisions of the Arbitration and Conciliation Act, 1996, as amended from time to time.
• The arbitration award will be final and binding on the Parties, and each Party will bear its own costs of arbitration and equally share the fees of the arbitrator unless the arbitral tribunal decides otherwise. The arbitrator shall be entitled to pass interim orders and awards, including the orders for specific performance and such orders would be enforceable in competent courts. The arbitrator shall give a reasoned award.
• Nothing contained in these Terms and Conditions shall prevent iPredikt from seeking and obtaining interim or permanent equitable or injunctive relief, or any other relief available to safeguard iPredikt's interest prior to, during or following the filing of arbitration proceedings or pending the execution of a decision or award in connection with any arbitration proceedings from any court having jurisdiction to grant the same. The pursuit of equitable or injunctive relief shall not constitute a waiver on the part of iPredikt to pursue any remedy for monetary damages through the arbitration described herein.
